We believe in legal action being the last resort and take all practical and economic steps to avoid this by using other
effective collection methods, for example collection letters and calls. However, some customers will not pay
unless legal action is taken and by this stage we feel they are simple not worth having as a customer.
If your debt is a commercial debt, you are entitled to claim costs and interest under the Late Payment of Commercial Debts (Interest) Act 1998. We ask for all court fees to be paid up-front. All court fees and our charges are payable in any event and will be invoiced when the action is taken. If the action is defended we will advise you in writing of the options and costs involved. Attachment of Earnings Please contact us for a quote. The court fees are recoverable but our costs are not. Both court fees and costs are payable in any event. Please note these charges only apply to Default proceedings. Claims that are defended will be outside of this agreement. In the event of claims being defended we will advise you in writing of your options and the costs involved. - Suggestion - If you want to reclaim costs and interest under your terms and conditions, it is important to make sure those terms are incorporated in your initial contract with your customer. It is usually best to present customers with your terms on the first meeting rather than on the back of an invoice when the work is completed. |
